TERMS OF SERVICE
This may be long but please take some time to read through this as it's what I'm going to work based on.
By commissioning me, it means you have read and accepted all the terms outlined below. If something is unclear, please don’t hesitate to send me an email or DM me through my social media!
PROCESS AND DELIVERY:
• As soon as I received your commission request, I will send back an email quoting it to confirm and whether I can accept it or not. • I will also notify when I am ready to start working on your commission as I may have multiple orders at once. • I will sketch out the piece and during this stage, you can ask for free at most 4 major changes (may vary depending on the complexity, I will elaborate further when we discuss) • After the final sketch is approved, I will send my paypal/ bank account info and notify the price. You can pay 100% or 50% here. • I will then do some color sketches and again you can review and change the color to your liking (free of charge). One this is approved, you will pay the remainings. • I may also make other reviews during the rendering phase. You can still make MINOR changes to your piece such as small details or small changes in the hand, etc. • Once the piece is finished you will receive the full-resolution image. Note that there are only digital files available!
REVISIONS:
• You get 4 rounds of any major changes during the sketching phase (see above for process) I will charge extra if you need more (see price list). • Normaly I will not do any major changes during the rendering phase (the pose, background, lighting, etc. but if you seriously need to then I also included it in the price list.
COPYRIGHT AND USAGE:
• I (the artist): o I reserve the right to cancel and refund the order at any time for any reason. (I will give a full refund for this) o I retain all copyright over the commissioned artwork even when I cancel the order o I will NOT claim the intellectual property (IP) of the commissioned artwork. o I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms. o I reserve the right to post the commissioned artwork online such as in social media, promote myself and in my portfolio. Posts on social media will include a watermark on it. • You (the customer/commissioner): o You may upload the commissioned artwork on any website and social channels (crediting me). o You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.). You can print it for personal use though, such as decoration. o You may NOT alter the commissioned artwork without my (the artist's) consent. o You retain the rights to the intellectual property (IP). o You may NOT use the commissioned artwork for commercial purposes. Please state your purpose in advance and prices may vary depending on this. • The following is considered as copyright infringement: o Reproducing/using the copyrighted artwork commercially - means making money off of it in any way not excluded from these terms. o Claiming the artwork as your own o Altering the artwork without my consent • In some cases, the commercial rights to the image may be purchased. Usually from 5-10 times the total price.
PAYMENT:
• Currency accepted is Euro and VND and can be paid through PayPal or bank transfer (Finnish /EU or Vietnamese bank). • You will pay the transfering and converting fee. (transfering service, PayPal) • Commissions can be paid either 100% after the sketch approval or split 50% after the sketch approval and 50% after color sketch. • Don't send me any payment until I have done the sketch and requested you to send me the payment.
CANCELLATION AND REFUND POLICY:
• The buyer is not allowed a refund once I started working on the commission. • If for any reason I am unable to continue with your commission you will receive a full refund. • If you cancel your order before I start, you can get a full refund. • If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself. • If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
